  • Minors, general ruleMost states prohibit tattooing anyone under 18 regardless of parental consent. A few (including Arizona, Washington, Wisconsin) allow tattooing of a minor with a parent present and signing. Piercing minimum ages vary. Confirm your state's minor body-art statute and do not rely on this template alone for minor procedures.
  • CaliforniaCalifornia Penal Code section 653 prohibits tattooing anyone under 18. California Health & Safety Code requires a written consent form meeting specific content and retention requirements for body art establishments. This template should be reviewed against the California Safe Body Art Act checklist.
  • New YorkN.Y. Public Health Law article 4-A requires written consent and specific health warnings for body art. The state Department of Health publishes a model consent form; your waiver should incorporate or reference it where appropriate.
  • TexasTexas Health & Safety Code chapter 146 requires specific disclosures, sterilization documentation, and written consent. Tattoo studios must be licensed and must retain consent forms for at least two years.
  • FloridaFlorida Statutes section 381.0077 and chapter 64E-28 of the Administrative Code require written informed consent and record retention. Minors may be tattooed only in the physical presence of a parent, with notarized consent in some cases.

Confirm enforceability in your state with local counsel. Waiver law changes, courts reinterpret statutes, and one bad clause can void the whole agreement. This template is a starting point, not legal advice.

Is this a waiver or a consent form?

Both, and that is deliberate. Body art is not a recreational activity that most courts treat as a simple liability-waiver scenario. It is a medical-adjacent procedure that requires informed consent. This document records consent and assumption of risk together, which is what state health codes typically require.

What are the state retention requirements?

Most states require tattoo and piercing consent forms to be retained for between two and seven years. Paper filing cabinets get raided during health department inspections and must be produced on demand. Digital storage through WaiverKit makes retention automatic and searchable.

Do I need a separate form for piercings?

The template covers both, but piercings have different aftercare and risk profiles. Most studios keep a single consent form with separate sections for tattoo and piercing, checked based on the procedure being done. Add or remove sections to fit your menu of services.

What if the client lies about medical conditions?

The template includes a clear self-disclosure clause so that a false statement by the client shifts liability. A digitally signed form timestamps the disclosure, which is much harder to dispute than a paper form filled in before the client has a reason to deny anything.

How do I handle the photo release for social media?
